This Indenture, made this First day of April in the Year of our Lord, one thousand eight hundred and forty eight, between Robert Holcomb and Mary Holcomb his wife, Elizabeth Parks, Hester Parks, Robert Parks and Sarah Parks of the County of Scott and state of Indiana of the first part and John Vest of the same place of the second part. Witnesseth. That the said parties of the first part, for and in consideration of the sum of Twenty five Dollars lawful money the receipt whereof is hereby acknowledged have granted bargained sold conveyed and confirmed and by these presents do grant Bargain, sell, convey and confirm unto the said party of the second part his heirs and assigns forever, all their undivided interest as children and heirs of Alexander Parks dec’d and heirs at Law of Hugh Parks Sr deceased in the following described tract of land lying and being in the county of Scott and State of Indiana and containing sixteen and one half acres more or less Towit: Lot no (1) one of the portion of the Real Estate of which the said Hugh Parks sr. died seized and possessed among heirs of said decedent by commissioners appointed by the Scott Circuit Court at the February term thereof in the year 1847 and by said commissioners appointed to said court at the August term thereof in the same year. For a more particular description of which together with metes and bounds of the same reference is made to the report of said commissioners also a platt of said land and the partition thereof, which now remains of record in said Court, the said term of August 1847, said Lot No (1) one being set apart by said commissioners to Synthia Parks, Elizabeth Parks, Hester Parks, Mary Holcomb, Alexander Parks and others the children and heirs of said Alexander Parks, died, and all the Estate, right, title, interest, claim and demand of them the said parties of the first part, of, in, and to the said premises and every part, thereof together with all and singular privileges and appurtenances to the same belonging, or in any wise appertaining and the rents, issues and profits thereof To Have and To Hold the premises hereby bargained and sold or meant or intended to be with the appurtenances to the only proper use and behoof of the party of the second party his heirs and assigns forever and the said parties of the first part, for themselves their heirs, executors, and administrators do covenant, promise and agree to and with the said party of the second part his heirs, executors, and administrators, will Warrant and forever defend the [?] said premises with their appurtenances and every part and parcel thereof unto the said party of the second part, his heirs and assigns, against all persons lawfully claiming or to claim from or under them, or any of them, or by, from or under any other person whomsoever.
